These Terms and Conditions (“Terms”) govern your access to and use of the GlobeCom platform, the GlobeCom Tracker mobile app, and all related services operated by GlobeCom (“GlobeCom”, “we”, “our”, or “us”).
By accessing or using GlobeCom’s services, you agree to comply with and be bound by these Terms.
If you do not agree, please do not use our services.
Definitions
- Platform: The GlobeCom web-based platform available at www.globecom.one.
- App: The GlobeCom Tracker mobile application available on App Store and Google Play.
- User: Any individual or entity that accesses or uses the Platform or App.
- Device: Any GPS tracking device or hardware integrated with GlobeCom services.
- Account: A registered user profile used to access GlobeCom’s services.
Acceptance of Terms
By creating an account or using the Platform or App, you confirm that you:
- Are at least 18 years old or the age of majority in your jurisdiction.
- Have the legal authority to enter into this agreement.
- Agree to comply with all applicable laws and these Terms.
If you are using GlobeCom on behalf of a company, you represent that you are authorized to bind that company to these Terms.
Services Provided
GlobeCom provides a cloud-based platform and mobile app for fleet, trailer, and asset tracking.
The services include:
- Real-time GPS location updates
- Historical route tracking
- Asset management and reporting
- Device status monitoring
- Secure data synchronization with supported GPS hardware
GlobeCom supports various Teltonika GPS devices (including TAT140, TAT141, FMC003, and others), as well as other devices upon request.
Account Registration and Security
To access the GlobeCom Platform or App, you must create an account or log in using existing credentials provided by GlobeCom.
You are responsible for:
- Maintaining the confidentiality of your login credentials
- Restricting access to your account
- Ensuring all information provided during registration is accurate and up to date
You agree to notify GlobeCom immediately at support@globecom.one if you suspect unauthorized access or account misuse.
Subscription and Payments
Access to the GlobeCom Platform and App may be subject to a subscription fee or prepaid plan, as described in your service agreement or quotation.
Billing Terms:
- Subscriptions are billed monthly or annually, depending on your plan.
- All fees are non-refundable once payment is processed, except as required by law.
- GlobeCom reserves the right to suspend or terminate access for non-payment.
If you purchase services through a GlobeCom partner or reseller, their billing terms may apply.
Use of Services
You agree to use GlobeCom’s Platform and App solely for lawful business purposes and in accordance with these Terms.
You must not:
- Use the Platform or App in any way that violates applicable law.
- Attempt to reverse-engineer, copy, or resell GlobeCom’s technology.
- Interfere with or disrupt the security or functionality of the Platform or App.
- Collect or process personal data using GlobeCom without proper legal basis.
GlobeCom may suspend or terminate access if it detects misuse or violation of these Terms.
Hardware Devices
GlobeCom integrates with GPS devices but does not manufacture hardware.
All hardware devices are covered under their respective manufacturer warranties (e.g., Teltonika).
GlobeCom is not liable for hardware malfunctions, network coverage limitations, or inaccurate data transmission caused by third-party devices or telecom networks.
Data and Privacy
Your data is processed in accordance with our Privacy Policy.
By using GlobeCom, you consent to the collection, processing, and use of data as described in that policy.
GlobeCom securely stores user and device data on encrypted cloud servers and adheres to applicable data protection laws, including GDPR.
Intellectual Property
All content, code, design elements, and trademarks on the GlobeCom Platform and App are the intellectual property of GlobeCom or its licensors.
Users are granted a limited, non-exclusive, non-transferable license to access and use the services for business purposes only.
You may not reproduce, modify, or distribute GlobeCom materials without prior written consent.
Service Availability
We strive to provide continuous access to the Platform and App.
However, GlobeCom does not guarantee uninterrupted or error-free operation.
Service interruptions may occur due to maintenance, updates, network issues, or other factors beyond our control.
GlobeCom will make reasonable efforts to notify users of planned downtime.
Limitation of Liability
To the fullest extent permitted by law:
- GlobeCom is not liable for indirect, incidental, or consequential damages arising from use of the Platform or App.
- GlobeCom’s total liability shall not exceed the total fees paid by the user during the six (6) months preceding the claim.
- GlobeCom is not responsible for losses caused by inaccurate GPS signals, hardware malfunction, or network failure.
Indemnification
You agree to indemnify and hold harmless GlobeCom, its officers, employees, and affiliates from any claims, damages, or losses arising from:
- Your misuse of the Platform or App
- Violation of these Terms
- Breach of data protection or third-party rights
Termination
GlobeCom reserves the right to:
- Suspend or terminate your account for breach of these Terms
- Delete data associated with terminated accounts after a reasonable period
You may stop using GlobeCom at any time by closing your account or contacting support@globecom.one.
Certain obligations (e.g., payment or confidentiality) will survive termination.
Changes to the Terms
GlobeCom may modify these Terms from time to time.
Updated versions will be posted at www.globecom.one/terms.
Continued use of the Platform or App after changes constitutes acceptance of the new Terms.
